Terms & Conditions

  • These Terms and Conditions (“Terms”) govern enrolment and participation in all classes, courses, subscriptions, private lessons, workshops, practice sessions, performances, and other activities conducted by Noir Dance Collective Pte Ltd (“NDC”, “we”, “us”, “our”).
  • By registering for, purchasing, or attending any Activity at NDC, you unconditionally acknowledge and agree to these Terms. (If you are under 18 years of age, you must obtain the written consent of a parent or legal guardian before enrolment.)

1. Amendments to Terms

  • NDC reserves the right to amend these Terms & Conditions at any time.
  • Any updated Terms will be published on the official NDC website or student portal and will take effect immediately upon publication.

2. Acknowledgement, Release & Waiver

  • I acknowledge that I am voluntarily participating in Activities provided by NDC, including but not limited to pole fitness, dance, Pilates (mat and reformer), yoga, conditioning, stretching, and related fitness or wellness classes.
  • I understand and accept that such Activities carry inherent risks of injury, illness, or death, including but not limited to falls, strains, fractures, joint or muscular injuries, cardiovascular risks, or aggravation of pre-existing medical conditions.
  • I participate entirely at my own risk. I release and discharge NDC, its directors, employees, instructors, contractors, agents, landlords, and affiliates from any and all Claims arising out of my participation.“Claims” means any loss, liability, suit, action, damage, expense, or injury, including but not limited to bodily harm, property loss, consequential damages, or claims made by my heirs or assigns.

3. Health, Medical & Conduct

  • I confirm that I am medically fit to participate in Activities and have consulted my physician regarding any injuries, illnesses, pregnancy, or other conditions.
  • NDC strongly advises that:
  • Pregnant participants should not engage in pole dancing, Pilates, Pilates reformer, yoga inversions, or advanced postures without express medical clearance. Participation is entirely at the student's own risk.
  • Students with cardiovascular, spinal, joint, or musculoskeletal conditions must disclose such conditions to instructors before class.
  • NDC strongly advises that:

    • Pregnant participants should not engage in pole dancing, Pilates, Pilates reformer, yoga inversions, or advanced postures without express medical clearance. Participation is entirely at the student's own risk.
    • Students with cardiovascular, spinal, joint, or musculoskeletal conditions must disclose such conditions to instructors before class.
  • I understand NDC instructors are not medical professionals. They may advise modifications but cannot guarantee injury prevention.
  • I will not attend Activities under the influence of alcohol, drugs, or prohibited substances.
  • I agree to conduct myself responsibly, respect other students, follow instruct guidance, and use equipment safely.
  • I acknowledge that Mat Pilates and Reformer Pilates involve core strengthening, controlled breathing, and spinal alignment techniques. While Mat Pilates uses minimal equipment, Reformer Pilates involves specialized spring-based resistance equipment that carries a higher risk of injury if improperly used. I agree to follow instructor guidance strictly and will not alter or adjust reformer settings without express supervision.
  • NDC strongly advises that pregnant students consult a physician before participating in Pilates, especially Reformer classes. Participation while pregnant is undertaken solely at the student's own risk.
  • Prohibited Substances & Smoking Policy

    • The use, possession, or distribution of illegal drugs, alcohol, vaping products, and e-cigarettes is strictly prohibited on NDC premises.
    • Smoking (including vaping) is not permitted inside the studio or within any common areas of the premises.
    • Any breach of this policy may result in immediate suspension or termination of membership or participation without refund, and NDC reserves the right to report such conduct to the relevant authorities.
  • In the event of an injury or medical emergency, I authorize NDC staff to administer basic first aid and/or arrange medical treatment as necessary. I understand that all associated costs will be my sole responsibility.

4. Code of Conduct & Behaviour

  • Students are expected to treat instructors, staff, and fellow students with respect at all times. NDC reserves the right to suspend or terminate the enrolment of any student who engages in disruptive, abusive, or unsafe behaviour without refund.

5. Children & Minors Clause

  • Students under the age of 18 must have a parent or legal guardian complete and sign a parental consent form prior to participation in any Activities.
  • Parents or guardians remain fully responsible for the minor's health, safety, and behaviour on NDC premises.
  • NDC reserves the right to refuse participation to minors in certain Activities that may be unsuitable due to safety risks.

6. Setting up Your Own Account

  • Each student must create and maintain an individual account in their own legal name. Accounts may not be shared, transferred, or used by third parties.
  • NDC reserves the right to deny entry to any person attending under another student's account.
  • Maintaining accurate and updated contact details in the account is the student's responsibility.

7. Class Placements & Transfers

  • Once payment has been processed, students are enrolled in the specific class, course, or level chosen.
  • Transfers to another level or class timing are subject to availability and an administrative fee of SGD $20.
  • NDC reserves the right to adjust class placements if it determines that a student's skill level is not suitable for the class registered.

8. Subscriptions, Memberships & Packages

  • Subscriptions

    • Subscriptions (monthly or recurring) provide access to specified classes as described at purchase.
    • Subscriptions auto-renew unless cancelled in writing at least 14 days before the next billing cycle.
    • Missed classes under subscription plans cannot be refunded or carried forward unless otherwise stated.

9. Packages

  • Class packages (e.g., 5-class, 10-class passes) must be used within their stated validity period. Expired credits are forfeited.
  • Private lesson packages are valid from 1-6 months depending on package type.

10. Transfers & Refunds

  • All purchases are non-transferable and non-refundable, except where expressly permitted under these Terms or Singapore consumer law.
  • Class transfers are subject to an administrative fee of SGD $20.
  • Refunds for medical reasons require a valid medical certificate and remain at NDC's discretion.
  • Fees paid are strictly non-refundable and non-transferable, except where expressly permitted by NDC.
  • Students unable to complete a course due to illness or injury may request a refund or class credit, supported by a valid medical certificate submitted before the course ends.
  • Refunds or credits will only be given at NDC's discretion and may be subject to administrative charges.
  • Refunds will not be granted for absences, changes in work schedule, relocation, or other personal commitments.

11. Cancellations & Attendance

  • Class cancellations must be made at least 48 hours before class (or 5 days for peak-hour classes). Otherwise, the class will be forfeited.
  • “No-shows” are strictly charged in full.
  • NDC reserves the right to cancel or reschedule classes due to unforeseen circumstances (e.g., low enrolment, instructor unavailability). Liability is limited to rescheduling or refund of the cancelled class.

12. Attendance, Lateness & No-Shows

  • Students must arrive on time for all classes. Entry may be refused once a class has commenced for safety reasons, and the class will be deemed forfeited.
  • Failure to attend without prior cancellation (“no-show”) will result in the class being fully charged or deducted from the relevant package or subscription.
  • Habitual lateness or repeated no-shows may result in suspension or termination of membership without refund.

13. Studio Etiquette & Safety

  • Students must arrive on time. Entry may be refused once class begins to ensure safety.
  • Proper attire is required:

    • Pole classes: shorts and tank tops (no lotions/oils).
    • Pilates: fitted attire and grip socks.
    • Pilates (mat): fitted attire that allows full range of motion, grip socks recommended.
    • Pilates (reformer): fitted attire and mandatory grip socks for hygiene and safety.
    • Yoga: flexible, stretchable clothing.
  • Students must return equipment (mats, blocks, straps, reformers, poles) neatly after use.
  • Students may not instruct others, attempt tricks beyond their level, or misuse equipment.

14. Pole Practice

  • Pole practice sessions are for personal training only. Students are not permitted to teach, instruct, or supervise other students during these sessions.
  • Students may not attempt tricks beyond their current class level or train with students of a different level.
  • Cancellations or changes to pole practice bookings are subject to an administrative fee of SGD $5. No cash refunds will be given; credits may be returned at NDC's discretion.

15. Personal Property

  • NDC is not responsible for loss, theft, or damage to personal property, including items left in lockers, common areas, or during classes.

16. Data Protection & Privacy

  • NDC collects, stores, and processes personal data (including names, contact details, payment information, and health disclosures) solely for the purposes of class registration, administration, and ensuring student safety.
  • All personal data will be managed in accordance with the Personal Data Protection Act 2012 (PDPA) of Singapore.
  • Personal data will not be shared with third parties without consent, except where required by law or for operational purposes (e.g., booking systems, payment processors).
  • Students consent to the use of photographs or video recordings taken during classes or events by NDC for promotional purposes, unless they have expressly opted out in writing.

17. Intellectual Property

  • All routines, sequences, class structures, choreography, flows, Pilates programming, yoga sequencing, and training methods taught at NDC remain the intellectual property of NDC.
  • Students may not reproduce, teach, record, or exploit such content for personal or financial gain without prior written consent.
  • The names, logos, and trademarks of NDC are protected and may not be used without prior written consent.

18. Photography, Video & Social Media

  • Students are not permitted to photograph, film, or record classes, instructors, or other participants without prior written consent from NDC.
  • Any unauthorised sharing of class material, choreography, or training methods on social media or other platforms is strictly prohibited.
  • NDC reserves the right to photograph or record classes, workshops, or events for training and promotional purposes. Attendance constitutes consent unless the student opts out in writing.

19. Promotions, Credits & Discounts

  • Referral credits, discounts, and promotional offers are applied only at checkout. They cannot be applied retroactively.
  • Referral credits are capped at SGD $50 per term and may only be redeemed on designated packages.
  • Promotional bundles (e.g., “Triple Bundle”, “Double Trouble”, or their future equivalents) are subject to specific validity rules as published and are strictly non-transferable and non-refundable.

20. Private Parties & Studio Hire

  • Bookings are subject to availability and require full payment in advance.
  • Cancellations less than 48 hours prior will result in forfeiture of 50% of payment.
  • NDC accepts no liability for injury or damage during third-party studio use.

21. Medical Emergencies & Insurance

  • NDC instructors may assist in emergencies but are not medical professionals.
  • In an emergency, NDC may, at its discretion, arrange medical assistance. Costs incurred will be borne by the participant.
  • Students are strongly encouraged to maintain their own personal accident and health insurance.

22. Limitation of Liability

  • To the fullest extent permitted by law, NDC shall not be liable for any indirect, incidental, or consequential damages arising out of participation in Activities.
  • NDC's aggregate liability shall not exceed the fees paid for the specific class or package in which the claim arose.

23. Force Majeure

  • NDC shall not be liable or responsible for any failure or delay in performing its obligations under these Terms where such failure or delay is caused by events outside its reasonable control.
  • Such events include, but are not limited to, government restrictions, public health emergencies, fire, flood, strikes, accidents, or acts of God.
  • In such cases, NDC may offer alternative arrangements (such as online classes) but is under no obligation to provide refund.

24. Severability

  • If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

25. Entire Agreement

  • These Terms constitute the entire agreement between NDC and the student. Any prior representations not contained herein are excluded.

26. Mediation Clause

  • Any dispute arising out of or in connection with these Terms shall first be submitted to mediation in Singapore under the rules of the Singapore Mediation Centre.
  • If the dispute is not resolved through mediation, it shall be referred to the exclusive jurisdiction of the Singapore Courts.

27. Governing Law & Jurisdiction

  • These Terms shall be governed by, and construed in accordance with, the laws of Singapore. Any dispute shall be subject to the exclusive jurisdiction of the Singapore Courts.
